Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Aurums software and any associated hosting services (the “Service”). By purchasing, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree, you must not use the Service.

1. Nature of the Service

1.1 Aurums provides a technical automation utility that executes trade instructions received from third-party sources selected independently by the user.

1.2 Aurums does not:

• Generate trade signals
• Select or filter trade instructions
• Modify entry, stop-loss, or take-profit levels
• Provide investment advice
• Manage portfolios
• Act as broker or intermediary

1.3 The Service performs mechanical automation only. All trading decisions originate from third-party providers chosen independently by the user.

2. No Investment Advice

2.1 The Service does not constitute investment advice, financial advice, portfolio management, or a regulated financial service.

2.2 Aurums does not assess suitability, appropriateness, or risk tolerance.

2.3 You are solely responsible for determining whether trading is appropriate for you.

3. High-Risk Activity Acknowledgement

3.1 Trading leveraged financial instruments carries a high level of risk.

3.2 You may lose some or all of your capital.

3.3 You accept full responsibility for:

• All trading outcomes
• All profits and losses
• Risk management decisions
• Broker selection
• Account configuration

4. Third-Party Signals

4.1 Trade instructions are provided by independent third-party signal providers selected by you.

4.2 Aurums does not verify, endorse, monitor, or guarantee the accuracy or performance of any third-party signals.

4.3 Aurums accepts no liability for losses arising from third-party trade instructions.

5. Software Status and Technical Risk

5.1 The software is experimental and may contain bugs, errors, or interruptions.

5.2 The Service is provided “as is” and “as available”.

5.3 The Service may experience:

• Delayed execution
• Missed trades
• Incorrect execution
• Connectivity interruptions
• Broker API changes
• VPS downtime
• Platform incompatibility

5.4 You acknowledge that automated execution may perform differently from manual execution.

6. Hosting Services (If Applicable)

6.1 Where VPS hosting is included, Aurums provides infrastructure only.

6.2 Aurums does not:

• Access your broker account
• Modify trades
• Exercise discretionary control
• Interfere with open positions

6.3 Hosting is provided without any uptime guarantee or service level agreement unless separately agreed.

6.4 Aurums is not responsible for:

• Broker outages
• Internet disruptions
• Market volatility
• Third-party infrastructure failures

7. Payment and Licence

7.1 Access to the Service is subscription-based.

7.2 If payment is not received:

• The software licence will deactivate.
• The Service will cease executing new trades.
• Open trades will not be modified or closed by the software.

7.3 Hosting services may be suspended or terminated following non-payment.

8. User Responsibilities

You are solely responsible for:

• Monitoring trading activity
• Ensuring correct lot sizing and leverage
• Ensuring compliance with applicable laws
• Maintaining broker account security
• Reviewing VPS activity
• Determining when to disable the Service

9. Limitation of Liability

9.1 Nothing in these Terms excludes liability where exclusion is not permitted by law, including liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation

9.2 Subject to clause 9.1, Aurums shall not be liable for:

• Trading losses
• Missed profits
• Execution delays
• Indirect or consequential losses
• Data loss
• VPS downtime
• Market-related losses

9.3 Aurums’ total liability in any 12-month period shall not exceed the total subscription fees paid by you during that period.

10. No Custody of Funds

Aurums does not hold, control, or access client funds and does not have authority over brokerage accounts.

11. Acceptable Use

You agree not to:

• Reverse engineer the software
• Resell or redistribute the software
• Share access credentials
• Attempt to replicate or clone the Service

Access may be suspended for breach of these Terms.

12. Data and Privacy

Aurums may collect:

• Email address
• IP address
• Usage logs
• Licence validation data

All personal data is processed in accordance with the Aurums Privacy Policy and applicable UK data protection law.

13. Amendments

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, where appropriate, via email. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

14. Termination

Aurums may suspend or terminate access:

• For non-payment
• For breach of these Terms
• At its discretion during experimental phases

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Acknowledgement

By using the Service, you confirm that:

• You understand the risks of leveraged trading
• You understand the software is experimental
• You are not relying on Aurums for investment advice
• You accept full responsibility for all trading outcomes
